Terms governing use of fundtec.ae, the content published on it, and any communication between visitors and Fundtec through this website.

1. Agreement to these terms

These Terms of Use ("Terms") govern access to and use of the website at fundtec.ae (the "Website"), which is operated by Fundtec, a corporate services and consulting firm with its office at DSO-IFZA, IFZA Properties, Dubai Silicon Oasis, Dubai, United Arab Emirates ("Fundtec," "we," "our," or "us"). By accessing or using the Website, the visitor agrees to be bound by these Terms. Visitors who do not agree should not use the Website.

2. No advisory or contractual relationship via the Website

The content on this Website is provided for general informational purposes only. It does not constitute legal, tax, regulatory, accounting, or investment advice for any specific situation, and it should not be relied upon as a substitute for advice from a suitably qualified adviser engaged for that purpose.

Use of this Website, sending an enquiry, or attending a discovery call does not create a client engagement, an advisory relationship, or a contract for services between the visitor and Fundtec. A client engagement is created only when Fundtec and the client have signed a written engagement letter setting out the scope, deliverables, fees, and other commercial terms.

7. Limitation of liability

To the fullest extent permitted by applicable law, Fundtec, its principals, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive losses, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with the use of the Website or any reliance on its content, whether based in contract, tort (including negligence), or any other legal theory, and even if Fundtec has been advised of the possibility of such losses.

Where Fundtec's liability cannot be excluded by applicable law, Fundtec's total aggregate liability arising out of or in connection with use of the Website is limited to the amount, if any, actually paid by the visitor to Fundtec in connection with the visitor's use of the Website in the twelve months preceding the event giving rise to the liability.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable UAE law.

8. Indemnity

Visitors agree to indemnify and hold Fundtec, its principals, employees, and contractors harmless from and against any claims, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of the visitor's breach of these Terms, the visitor's misuse of the Website, or the visitor's violation of any applicable law or third-party right.

Personal data submitted to or collected by the Website is handled in accordance with the Fundtec Privacy Policy, which forms part of these Terms.

10. Changes to the Website and to these Terms

Fundtec may, at its discretion, modify, suspend, or discontinue any part of the Website at any time and without notice. Fundtec may also update these Terms from time to time. The "last updated" date at the top of these Terms reflects when they were most recently revised. Continued use of the Website after the Terms are updated constitutes acceptance of the revised Terms.

11. Governing law and jurisdiction

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any dispute arising out of or in connection with these Terms, including any question regarding their existence, validity, or termination, is subject to the exclusive jurisdiction of the competent courts of the Emirate of Dubai, save where applicable mandatory law provides otherwise.

12. Severability and waiver

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect. A failure by Fundtec to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.
